Motorcyclist Killed in San Marcos Accident, Passenger Injured

A 20-year-old motorcyclist died early Saturday morning in San Marcos at the intersection of East Mission Road and Mulberry Drive. Motorcycle rider fatalities have been on the rise since 1997. A report card issued by the National Highway Traffic Safety Administration for 2004 states that 4008 motorcyclists died in 2004 and 76,000 were injured.

A 20-year-old motorcyclist died early Saturday morning in San Marcos at the intersection of East Mission Road and Mulberry Drive. Nathan Anthony Jumainpol, the driver of the motorcycle, was pronounced at the scene. There were no other vehicles involved in the crash. A female passenger on Jumainpol's motorcyle suffered major injuries, and was taken to Palomar Medical Center for treatment.

Motorcycle rider fatalities have been on the rise since 1997. A report card issued by the National Highway Traffic Safety Administration for 2004 states that 4008 motorcyclists died in 2004 and 76,000 were injured. About half of all motorcycles involved in a fatal crash collided with another vehicle. More than one-third of cyclists that died were speeding, approximately twice the rate for drivers of passenger vehicles or light trucks. Almost half of the fatal accidents show alcohol involvement. One out of four motorcycle operators that were involved in fatal crashes had an invalid license. Helmets saved approximately 1158 lives in 2003; another 640 lives could have saved if helmets were worn.

From a legal perspective, the passenger on Jumainpol's motorcycle would likely have a legal claim against the estate of Jumainpol for her injuries.
